Disclaimer/Terms and Conditions
Terms and conditions of sale are agreed between the buyer and the purchaser. Agreement/Disclaimer outlined below.
1. Any person who rides or handles a horse for sale at Hillview does so entirely at their own risk. Hillview Thoroughbreds does not assume or accept any responsibility or liability for any accident, damage, injury to horses, riders or handlers, animals, ground, spectators or any other person or property, whatsoever! Any person requesting to ride, handle any horse must be suitably attired for riding including boots and riding hat.
2. Hillview Thoroughbreds does not allow any horse to go out on trial.
3. Horses will not be held for any purchaser unless there has been at least a 10% non refundable deposit made.
4. The purchaser accepts that in buying the horse, there will be no refund of monies paid for a horse that has been purchased from Hillview Thoroughbreds. There is no cooling off period on the sale of any horse.
5.The purchaser is responsible for inspection of any horse prior to sale. Such inspection may include advice by any qualified person, if deemed necessary. Vet checks are welcome but not obligatory. They are at all times at the discretion of the purchaser and their cost. Before a vet check is conducted a non-refundable 10% deposit will be required. There will be no responsibility taken for the health or soundness of any horse once it is paid for. If the purchaser is requiring a vet check there will be no negotiations in purchase price - So please do not ask..
6. Payment is only accepted by electronic transfer, cash or bank cheque. No personal cheques will be accepted.
7.Payment to be made in full within 48 hours of agreement/vet check etc.
6. Transport is not the responsibility of Hillview Thoroughbreds it is at the purchasers cost. The horse is deemed to have left the care of Hillview Thoroughbreds once in the hands of the person collecting the horse. We use and prefer Sydney Horse Transport and RB Horse Transport.
7. From day four of agreement/vet check/deposit/payment, an agistment fee of $25.00 per day will be charged and payable on or before collection of the horse.
8. The purchaser recognises that horses behave differently for different riders and handlers, in different locations and circumstances. Once the horse has left Hillview we take no responsibility for the behavior of horses once they have left the our care and premises.
9. The purchaser acknowledges that the horse has been described as accurately as possible during the sales process.
10. Hillview Thoroughbreds is unable to provide a guarantee on the suitability of any horse. Purchasers must rely on their own inquiries in this regard.
11. The purchaser is deemed to be the owner of the horse upon payment of the full amount of the purchase price. Any injuries/illnesses sustained between payment and collection of the horse are the responsibility of the buyer. Hillview Thoroughbreds suggest insurance which is at the purchasers cost.
12. Payment Plans: Aren't encouraged by Hillview Thoroughbreds but will be considered at the discretion of Hillview Thoroughbreds. At least half or a third deposit (depending on purchase price) will be required up front. A legal document will also be required to be signed. Horse should/must be insured by the purchaser at their cost. Interest will be charged at a rate of 10% after a 3 month period.
13. For legal reasons, unfortunately we now require that anyone coming to inspect horses, must all sign a legal release document. Please contact for a copy so that one can be emailed or posted.
14. A purchase agreement will also be required for all purchases.
